Negotiating With Your Best Interests at the Center

The Initial Agreement and Deposit

Once both parties reach agreement, you will both sign the Purchase Agreement and the buyer will place a deposit into an escrow account managed by a neutral third party, either a title company or a closing attorney. That party holds and distributes all associated funds through to the closing date.

Depending on the state, legally binding agreements typically require consideration, which is the buyer's deposit held in escrow pending fulfillment of the contingencies outlined in the Purchase Agreement.

A few things to keep in mind as the process moves forward:

  • Keep written records of everything. Every counteroffer, verbal agreement, and addendum should be documented and signed by both parties. We handle the drafting and ensure both sides have copies.
